1. Agreement
These Terms and Conditions govern your use of seobangkok.com (the "Site") and any consulting or marketing services provided by SEO Bangkok ("we", "us", "our"). By using the Site or engaging our services, you agree to these Terms.
If you do not agree, do not use the Site or engage our services.
2. About us
SEO Bangkok is a founder-led consultancy based in Bangkok, Thailand, providing search engine optimization, paid search management, and related digital marketing services. Contact for all matters: [email protected].
3. Use of the Site
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of it. Prohibited activities include, without limitation:
- Attempting to gain unauthorized access to the Site, its server, or any connected database.
- Using the Site to transmit malware, spam, or unsolicited commercial content.
- Scraping, harvesting, or systematically copying Site content except as expressly permitted.
- Using the Site to impersonate any person or misrepresent your affiliation with anyone.
4. Services
Any services we provide are subject to a separate written agreement ("Engagement Letter" or "Statement of Work"), which sets out scope, deliverables, fees, timelines, and acceptance criteria. In case of conflict between these Terms and an Engagement Letter, the Engagement Letter prevails for matters it addresses.
Our services are advisory and execution-based. We make no guarantee of any specific ranking, traffic, conversion, or revenue outcome, because such outcomes depend on factors outside our control (including search engine algorithms, competitor activity, client implementation, and market conditions). We do commit to applying 20+ years of professional expertise in good faith, using industry-standard methods, toward the goals defined in the Engagement Letter.
5. Fees and payment
Fees, invoicing schedule, and payment terms are set out in the Engagement Letter. Unless otherwise agreed, invoices are payable within 14 days of the invoice date. Late payment may result in work being paused and may, at our discretion, attract interest at the rate permitted by Thai law.
All fees are stated exclusive of applicable taxes (including Thai VAT where it applies), which will be added and itemised on the invoice.
6. Intellectual property
The Site, including text, graphics, logos, images, and code, is owned by SEO Bangkok or its licensors and is protected by copyright, trademark, and other laws. You may view and print content for personal, non-commercial reference. All other use, including reproduction, modification, redistribution, or commercial use, requires our prior written permission.
Work product delivered under an Engagement Letter (reports, audits, content, recommendations) is generally licensed or assigned to the client as specified in that agreement. Our underlying methodologies, templates, checklists, and know-how remain our property and may be reused on other engagements.
7. Confidentiality
Each party agrees to keep confidential any non-public information received from the other in connection with an engagement, and to use such information only for the purpose of performing or receiving the services. This obligation survives termination of the engagement.
8. Third-party links and platforms
The Site may link to third-party websites, and our services may involve third-party platforms (for example, Google, Microsoft, Meta). We are not responsible for the content, practices, or availability of third-party sites, and third-party platforms are governed by their own terms. Your use of those platforms is at your own risk.
9. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, secure, or free from viruses.
Content on the Site (including blog articles) is provided for general information only and does not constitute professional advice for any specific situation. You should not act on Site content without first seeking advice tailored to your circumstances.
10. Limitation of liability
To the maximum extent permitted by applicable law, SEO Bangkok shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Site or our services, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or in connection with any engagement, whether in contract, tort (including negligence), or otherwise, shall not exceed the total fees paid by the client to us under the relevant Engagement Letter in the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Thai law.
11. Indemnity
You agree to indemnify and hold harmless SEO Bangkok and its founder from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or your infringement of any third-party rights.
12. Termination
We may suspend or terminate your access to the Site at any time, without notice, if we reasonably believe you have breached these Terms. Termination of any engagement is governed by the Engagement Letter.
13. Governing law and jurisdiction
These Terms are governed by the laws of the Kingdom of Thailand, without regard to conflict-of-laws principles. Any dispute arising out of or in connection with these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.
14. Changes
We may update these Terms from time to time. The effective date at the top of this page indicates when they were last revised. Continued use of the Site after an update constitutes acceptance of the revised Terms.
